What Is a Separation Agreement?

A separation agreement is a written contract between divorcing spouses that lays out the terms of their divorce and addresses:

Is a Separation Agreement Required in Massachusetts?

Not every Massachusetts divorce involves a separation agreement, but most do. If you're pursuing an uncontested divorce, a separation agreement is required; you can't file that type of case without one.

If your case starts out being contested, it doesn't begin with a separation agreement. Most contested cases settle before trial, and when they do, the parties negotiate the terms. 

It's only when a divorce is fully litigated to trial that no separation agreement comes into play, since the judge decides the disputed issues directly and enters a judgment.

Merger vs. Survival: A Distinction That Matters

One of the most important, and most overlooked, decisions in any Massachusetts separation agreement is whether its terms "merge" or "survive" your divorce judgment, and getting this wrong can have consequences for years.

Merged terms become part of your divorce judgment itself. Because a court always retains the power to revise its own judgments, merged terms can later be modified if one spouse shows a significant change in circumstances. 

Massachusetts law requires that child-related terms, like custody and child support, always remain modifiable this way, since a child's needs can change over time.

Terms that survive the judgment stand as an independent, binding contract between you and your spouse, separate from the judgment itself. Surviving terms generally cannot be modified later, even if circumstances change substantially. They are enforced as a contract rather than through the court's ordinary modification process.

Whether a given term should merge or survive depends heavily on your specific situation, and it's a decision worth making deliberately, with legal advice, rather than accepting boilerplate language you don't fully understand.
