Courts generally need evidence of specific behavior, not broad accusations. A pattern may become significant when it repeatedly disrupts contact, weakens parental authority, or draws the child into adult disputes.

Conduct worth documenting may include:

How Massachusetts Courts Evaluate Alleged Interference

Massachusetts Probate and Family Court judges decide custody issues according to the best interests of the child. The court may consider each parent’s conduct, caregiving history, family relationships, cooperation, allegations of abuse or abandonment, and the effect of living conditions on the child’s physical and emotional health.

Allegations of interference can affect disputes involving shared legal custody, sole physical custody, parenting time, contempt and enforcement, or a custody modification. The legal effect depends on the evidence and circumstances. Depending on the child’s age and maturity, the court may consider the child’s preference without treating it as controlling.

Some cases involve a guardian ad litem, a neutral individual appointed to investigate and report on specific issues identified by the court. Whether that appointment or other professional involvement is appropriate depends on the disputed facts and the procedural posture of the case.

Building Evidence in a Parenting-Time Dispute
