The Adult Guardianship Process in Salem, Massachusetts

Adult guardianship and conservatorship proceedings are governed by Article V of Massachusetts General Laws chapter 190B. Salem-area families file petitions in the Essex Probate and Family Court, which serves Essex County. The court reviews the petition and supporting information before deciding whether the legal requirements for an appointment have been met.

We examine which decisions the adult can and can’t make independently, the assistance already available, and the authority the family believes is necessary. This assessment defines the issues before the court without assuming that a diagnosis alone establishes incapacity. It also distinguishes personal decision-making needs from financial matters that may require a separate conservatorship.

A proceeding may be contested if the proposed incapacitated person or another interested party objects to the appointment, the proposed guardian, or the requested scope of authority. Massachusetts Standards for Appointing an Adult Guardian

A Massachusetts court may appoint a guardian after finding that an adult is incapacitated, that the appointment is necessary or desirable for continuing care and supervision, and that other available supports can’t meet the person’s needs. Less restrictive means are supports that address those needs while preserving more independence and legal decision-making authority.

The court’s analysis is specific to the individual. It considers the person’s functional limitations, available support, and ability to make or communicate relevant decisions. Appropriate technological assistance is among the alternatives the court must consider.

A guardian may receive authority concerning the adult’s support, care, education, health, and welfare, but that authority isn’t unlimited. The court grants only the authority required by the person’s demonstrated limitations, so an appointment may be tailored rather than transferring every personal decision to the guardian.

Adult Guardianship, Conservatorship & Other Options

Guardianship and conservatorship address different responsibilities. A guardian makes court-authorized decisions involving personal needs, while a conservator is separately appointed to manage property, income, and business affairs. Appointment as guardian doesn’t automatically provide control over the adult’s financial assets.

The same person may serve as both guardian and conservator, but the court grants each role separately. Whether both appointments are appropriate depends on the adult’s personal and financial circumstances. We help families identify the authority they’re seeking so that personal care concerns aren’t confused with asset management.

A full guardianship may not be necessary when valid legal documents adequately address the decisions at issue. A durable power of attorney can authorize another person to handle specified financial or legal matters, while a health care proxy can designate someone to make health care decisions under the document’s terms. Their validity, scope, and sufficiency must be evaluated in light of the adult’s current needs.

Rights in an Adult Guardianship Proceeding

The proposed incapacitated person retains due-process rights designed to provide notice and a fair opportunity to participate. These rights include:

Attending the guardianship hearing
Being represented by counsel
Presenting evidence
Cross-examining witnesses

If the person or someone acting on their behalf requests counsel, the court appoints an attorney. The court also appoints counsel when it determines that the person’s interests may not be represented adequately. When applicable, the court considers the proposed incapacitated person’s choice of attorney.

These protections matter because a guardianship order can shift authority over significant personal decisions. If an appointment is made, the guardian must exercise only the authority granted by the court. Decisions concerning the adult’s support, care, health, welfare, and other personal needs remain subject to the limits stated in the appointment.
