Father without child custody takes boy in Massachusetts

Massachusetts State Police recently arrested a man who appears to have taken the law into his own hands. Police say the man took his 3-year-old son from the home of the child's mother in Plymouth, assaulting the mother in the process. Apparently, the man does not have child custody rights concerning the boy. The removal of the child was termed a parental kidnapping, and a search ensued for the boy and the father. The good news is that they were found and the child was unharmed.

It remains unclear what may have led the father to take the child.  Reportedly, the parents are estranged, though further details were not divulged. It is said that the father fled with the boy from the mother's house shortly before 9 a.m. on June 28. 

The authorities quickly publicized that they were searching for the man, indicating that he could be armed. Identifying details regarding the man, his vehicle and that fact that he could possibly be headed toward Lynn were reported in the media. Thankfully, the man was apprehended within three hours of the frightening incident.

Child custody issues can be stressful under any circumstances. This man will now have to answer in a Massachusetts criminal court for his actions, which may significantly impact any future right to see his child. It is unclear if a child custody order exists, though it is apparent the man acted without any legal authorization. When these types of family law issues exist, the best approach is to secure representation to address any issues in court rather than unilaterally resort to self-help.
