Domestic Violence Charges in Massachusetts

In Massachusetts, police have a mandatory arrest policy when they are called to a home for alleged domestic violence; when the police receive an allegation of domestic assault and battery, they go to the location intending to make an arrest.

Once an arrest has been made, the reporting party does not have the option of dropping charges - the case is now in the control of a district attorney. Since the penalties for a domestic assault or battery charge are severe, it is critical that the accused hires an aggressive, effective criminal defense attorney to fight for them.

Victims of domestic violence who wish to drop the charges against the accused often face an uphill battle. The victim may be contacted by a victim/witness advocate, who will gather evidence about the victim and make suggestions to the court on how to handle the case. This individual will likely pressure the victim to testify against the accused, and the court may request that the victim testify.

As experienced criminal defense attorneys, we have seen many cases in which an individual is falsely accused of domestic violence or a restraining order violation. During a divorce, child custody dispute or other family law matter, individuals may make abrupt decisions based on heated emotions. Suddenly, the accused may find him or herself under a restraining order - and potentially losing parental rights.

At the Law Office of Jennifer B. Koiles & Associates, we aim to protect clients faced with domestic violence charges and restraining order violations. Those accused of domestic assault and battery can face severe penalties. When representing a client, we thoroughly investigate their case and work diligently to protect their rights. A skillful defense lawyer can raise issues that may resolve a case without the necessity of going to trial and without the necessity of admitting to the charge or pleading guilty. However, if trial becomes necessary we vigorously and effectively defend the rights of our clients.
